Hill was convicted of killing a fellow inmate in 1990, while he was serving a life sentence for the murder of his girlfriend. For years, Hill’s lawyers argued he had an intellectual disability and should be spared from the death penalty. But the state argued Hill failed to prove beyond a reasonable doubt he is intellectually disabled. Georgia has the toughest burden of proof in the country for defendants seeking to avoid execution because of intellectual disability. Supporters of Hill, including advocates of those with disabilities and former President Jimmy Carter, wrote letters that were included in Hill’s clemency application to the Georgia Board of Pardons and Paroles Monday. The Board denied clemency early Tuesday morning. About a couple dozen supporters of Hill also held a vigil outside the state prison near Jackson, Georgia. Priest Joseph Shippen with Episcopal Diocese of Atlanta said he was disappointed with the courts’ decisions. “We should really question how we can, as Georgians, put to death someone who has the mentality of a child. Is that the kind of state we want to be?” Shippen said. It’s unclear whether state lawmakers will revisit Georgia’s burden of proof legal standard.
